Tenants of municipal property reminded to pay off debts

Otherwise, the Bishkek City Council will be forced to refer the matter to the judicial and law enforcement authorities to collect the debt, as well as take other necessary measures in accordance with the current legislation of the Kyrgyz Republic, up to and including the cancellation of existing lease agreements and the dismantling of facilities.

With regard to non-residential premises, based on the provision ‘On the procedure for managing movable and immovable property owned by the municipality of Bishkek and granting limited property rights to them,’ approved by Bishkek City Council Resolution No. 60 of 16 December 2022, the mayor's office will take measures to evict tenants who avoid paying for the use of municipal property.

For non-residential premises, if the tenant fails to make payments for more than two consecutive months after the expiry of the rent payment deadline, the contract is subject to early termination unilaterally at the request of the landlord.

For land plots provided for 5 or more years, the special terms of the lease agreement stipulate that the tenant will be disconnected from electricity and water supply until the debt is fully repaid. In addition, in the event of a breach of obligations to pay rent, a penalty of 0.1% of the amount of the debt shall be charged for each day of delay, but not more than 25% of the principal amount.

For light structures, based on the provision ‘On the procedure for granting land plots for temporary use for light structures on lease terms in the city of Bishkek,’ the structures are subject to demolition if they are operating without the proper permits for placement; in the event of new construction; by court order or by decision of the authorised body in the event of a breach of the terms of the contract or non-payment of rent for 3 months.
