    The Ministry of Labour, Social Development and Migration has reminded that, in accordance with the Labour Code of the Kyrgyz Republic, employees are entitled to 28 calendar days of paid annual leave.

    The right to take leave during the first year of employment arises after 11 months of continuous employment with the same employer, but by agreement between the parties, leave may be granted earlier.

    The Ministry of Labour, Social Development and Migration explained that leave must be granted annually and may be divided into parts by agreement between the employee and the employer. The duration of leave is calculated in calendar days, with non-working public holidays falling within the leave period not included in the number of calendar days and not paid.

    The working year entitling an employee to leave includes the time actually worked, as well as periods when the employee did not work but retained their job (position). Such periods include annual leave, forced absence due to unlawful dismissal, and other periods provided for in a collective or employment contract. However, the working year entitling the employee to leave does not include time absent from work without valid reasons, childcare leave, or unpaid leave lasting more than 14 calendar days.

    The employer must notify the employee of the start date of the leave no later than two weeks in advance. Payment for leave must be made no later than three working days before it begins. If an employee is recalled from leave, they are entitled to use the remaining part of their leave at a time convenient for them during the current working year or to add it to their leave for the following year.

    Certain categories of employees are entitled to take leave at a time convenient for them. Leave is formalised by an order or a leave note signed by the employer, who is also required to keep records of leave granted.

    Compliance with labour legislation regarding the granting of leave is the responsibility of all employers in the country.

    The ministry also notes that in the event of non-compliance with labour legislation, Kyrgyz citizens can hold employers accountable by writing a statement to the labour law control and supervision service.
