The State Committee for National Security opposed the creation of a commission to review criminal cases

The State Committee for National Security of Kyrgyzstan commented on initiatives circulating in the media regarding the creation of an interdepartmental commission to review criminal cases investigated by the SCNS over the past five years.

The agency stated that such proposals contradict current legislation and constitutional principles.

According to the Constitution of the Republic, state power is based on the principle of separation of functions and powers between state bodies. Oversight of the legality of criminal investigations by investigative units, including the SCNS and the Ministry of Internal Affairs, is carried out by the prosecutor's office, and justice is the exclusive competence of the judicial system.

The SCNS recalled that, in accordance with Article 8 of the Criminal Procedure Code, sentences and other court decisions may be reviewed and revised only by courts in accordance with the procedure established by law. Procedural decisions of investigators, in turn, are subject to control by supervisory authorities.

Thus, the creation of any commission to review criminal cases is not provided for by law and may be considered interference in investigative and judicial activities.

The committee also noted that, on the instructions of the head of state, a reform of the SCNS is being carried out, covering virtually all areas of its work. The changes are aimed at adapting national security agencies to modern threats, strengthening intelligence and counterintelligence activities, combating terrorism and extremism, countering corruption and organized crime, and ensuring the country's information and economic security.
