The tax office will not be able to debit money from accounts without a confirmed debt

The Jogorku Kenesh passed a bill that could significantly change the tax collection procedure familiar to citizens. It concerns the introduction of tax payment requirements for individuals. This means that the state will have the right to directly debit money from debtors' accounts.

During the discussion, MP Guly Kožokulova expressed concern that the innovation would complicate citizens' lives. However, the head of the State Tax Service, Almambet Shykmamatov, emphasised that this applies exclusively to recognised and undisputed debts.

Tax debts recognised by the taxpayer themselves include amounts that:

  • are indicated by the taxpayer in their tax returns;
  • are assessed by the tax authority and have not been appealed within the time limit established by law;
  • are confirmed by a court decision that has entered into force;
  • are directly recognised by the taxpayer themselves through a submitted application.

Thus, we are talking about debts that are confirmed by the taxpayer themselves or confirmed by court or tax authority decisions that have entered into force. Such debts are considered established and subject to enforcement.

‘The application of tax payment requirements for individuals will simplify the debt collection procedure and will not complicate the lives of citizens, as there will be no need for procedures involving bailiffs, such as imposing restrictions on leaving the country and paying additional fees,’ Shykmamatov emphasised.
