There are calls to place business inspections in Kyrgyzstan under the control of the public prosecutor’s office

A draft law has been tabled in the Parliament proposing changes to the procedure for conducting inspections of businesses. The authors of the initiative propose making it compulsory to register all scheduled and unscheduled business inspections with the public prosecutor’s office.

A draft law entitled ‘On Amendments to the Law of the Kyrgyz Republic “On the Procedure for Conducting Inspections of Business Entities”’ has been submitted to parliament.

Under the initiative, the current mechanism for coordinating inspections is proposed to be replaced by mandatory registration with the public prosecutor’s office.

The drafters believe that the current procedure does not always prevent repeat inspections and unjustified interference by regulatory bodies in the activities of businesses.

If the law is passed, the public prosecutor’s office will monitor:

  • compliance of inspection plans with legal requirements;
    adherence to the timings and frequency of inspections;
  • the justification for including companies in inspection plans;
  • the absence of duplicate inspections;
  • the existence of grounds for unscheduled inspections.

Scheduled inspections will be registered on the basis of official orders, whilst unscheduled inspections will also be subject to prior registration. In the event of exceptional circumstances, an inspection may be carried out without prior registration, but the details must subsequently be entered into the system.

According to the authors of the bill, transferring the function of registering inspections to the Public Prosecutor’s Office will enable the creation of a unified register of inspections, reduce the administrative burden on businesses and increase the transparency of the work carried out by supervisory authorities.
