Kyrgyzstan Has Banned the Sale of Apartments in New Buildings Until the Foundation Is Completed

In Kyrgyzstan, developers are prohibited from selling apartments and non-residential premises, accepting payments from buyers, and advertising properties under construction until the “zero cycle” is completed. The new requirement is aimed at protecting citizens’ funds and reducing risks when purchasing housing in the early stages of construction.

According to an order by Minister of Construction Nurdhan Oruntayev, the “zero cycle” refers to the construction of the foundation and the complete completion of underground construction work.

Until this stage is completed, developers are prohibited from:

  • selling apartments and non-residential premises;
  • entering into shared-ownership agreements and preliminary contracts, as well as other transactions involving the raising of funds for construction;
  • advertising construction projects.

The Department of State Architectural and Construction Control is responsible for monitoring compliance with these requirements. The agency will identify violations related to advertising, the sale of real estate, and the raising of funds from buyers.

The Ministry of Construction reported that it is already conducting outreach with construction companies. Their executives have been briefed on the new requirements and warned of the consequences of violations.

The measure is aimed at protecting buyers from financial risks when investing in projects that have not yet reached the full-scale construction phase.
