The government has decided to legalize unregulated construction in Kyrgyzstan under new rules

The Cabinet of Ministers of Kyrgyzstan has amended the procedure for implementing the land amnesty. The new rules apply to plots with so-called haphazard development and provide for the involvement of a separate state commission in the land legalization process.

The relevant changes were approved by a Cabinet resolution dated May 15, 2026. The document was adopted in accordance with the presidential decree “On Measures to Complete the Work on the State’s Confirmation of Citizens’ Property Rights to Land Amnesty Objects.”

Under the new rules, the Land Amnesty Commission will now be able to identify groups of land plots with haphazard development. This refers to areas where, prior to December 1, 2021, residential buildings or unfinished structures were built that are located in close proximity to one another or are geographically interconnected.

For vacant plots included in such groups, the materials will be forwarded to a special State Commission on Land Plot Legalization. It is this commission that will decide whether a plot can be legalized or must be expropriated into state ownership.

The State Commission must review the documents within 30 calendar days. Based on the results of the review, three options are possible:

  • permission to legalize the plot;
  • a decision to expropriate the land for the state;
  • return of the materials for revision.

The Cabinet of Ministers also stipulated that in the event of a negative decision by the commission, the materials may be forwarded for consideration of the issue of transferring the land plot to state ownership. At the same time, the authorities have left open the possibility of reconsidering a denial if the plot is later recognized as falling under the land amnesty.

The basic regulation on land amnesty has been in effect in Kyrgyzstan since 2022. It governs the procedure for securing ownership rights to land plots and residential buildings constructed without a complete set of documents.

The land amnesty itself applies to properties covered by the Law “On the Regulation of Land-Legal Relations.” To formalize these rights, special commissions are established within local administrations and city halls; these commissions review citizens’ applications, coordinate with government agencies, and compile lists of properties eligible for legalization.
