    Ministry of Construction submits unified procedure for issuing permits and connecting to networks for discussion

    On June 19, a draft order from the Ministry of Construction, Architecture, and Housing and Communal Services of the Kyrgyz Republic was posted on the public discussion platform. The order is intended to radically change the current procedure for obtaining permits in the field of construction and connecting facilities to utility networks. The document establishes uniform, transparent, and orderly rules covering the entire process, from the submission of an application to the commissioning of a facility. The discussion of the draft will continue until June 29.

    For the first time in regulatory practice, it is proposed to clearly regulate each stage of the process — from the preliminary design to the actual connection to water supply, power grids, communication systems, and other types of engineering services. The document is based on a differentiated approach, whereby the type and scale of the facility will determine the level of complexity of the procedure. Three formats are provided: general, simplified, and maximally simplified. This will reduce bureaucratic costs in the construction of small facilities and, conversely, strengthen control over large and complex projects.

    Thus, for highly complex facilities, including buildings with an area of more than 1,000 square meters, industrial enterprises, engineering structures, and buildings higher than three stories, a general procedure is provided. It covers the entire range of urban planning and design approvals, including mandatory state expertise, as well as the maintenance of a register of facilities under construction.

    For medium-sized buildings — from 300 to 1,000 square meters and up to three stories high — a simplified procedure is proposed that eliminates excessive documentation. In this case, it will be sufficient to develop a preliminary design, obtain an urban planning conclusion and technical specifications, agree on the main sections of the project documentation, and start construction.

    The most simplified procedure is provided for individual housing up to 300 square meters, light structures in the tourism sector (glamping, airframes, yurts), terminals, ATMs, and other non-capital facilities. In such cases, only a basic set of documents will be required, without the need for expert reviews.

    The draft pays special attention to digitalization. A “single window” principle is being introduced, whereby all interactions between developers, government agencies, and engineering services will be carried out through a single channel. This will eliminate the need to contact dozens of agencies and simplify the procedure for obtaining permits. All payments will also be centralized and issued through the relevant territorial authorities.

    The authors of the document promise that the time for reviewing applications will be limited to 30 working days, and connection to engineering networks will be carried out exclusively on the basis of technical conditions, which will eliminate arbitrary refusals and increase the predictability of the process.
